Harmony Professional Portal Terms

1. Your professional account
These terms apply when you create or use a Harmony professional account. They supplement Harmony's Terms of Service, Privacy Policy, and Consumer Health Data Privacy Policy. If these terms conflict with the general Terms of Service, these terms control only for your use of the professional portal.
You must be a currently licensed therapist, counselor, psychologist, clinical social worker, or other licensed behavioral-health professional in every jurisdiction you list. You must provide accurate information, keep it current, and use your own professional email and account.
Your portal account becomes available after you complete signup. Account access does not mean Harmony endorses you or has verified every credential. Harmony may check licensing-board records directly or through a credential-verification provider and will show a verified status only after a primary source confirms it.
2. Using Harmony with clients
Harmony is an optional relationship-wellness and communication-practice tool. Use it only when you believe it is appropriate for a client and within your license, scope of practice, professional duties, and local law.
A client decides whether and how to use Harmony. You may not make Harmony, use of your Harmony code, a professional connection, or expanded sharing a condition of care. Do not pressure a client or partner to share private material.
3. Client privacy and control
Entering your Harmony code does not identify a person to you. You see a named client or Harmony activity only after that person connects you and chooses the exact areas and time range to share.
Each person controls their own connection and permissions. Pairing with a partner does not share that partner's private material or connect the partner to you. A client may change or remove access at any time, and you must honor the current permissions shown in the portal.
Use client-authorized information only to support that client's care. Do not sell it, use it for advertising, add it to an unrelated profile, or disclose it except as the client directs or law requires.
4. Questions, exports, and professional guidance
A client may send a one-time counselor export or connect you for ongoing access. Harmony answers your questions using only the records the client currently permits. Removing access prevents those records from being used in future portal views and AI answers.
You may add a recommendation or exercise only when the client allows professional guidance. Guidance for one person remains scoped to that person. Guidance for a couple requires the permissions shown for both partners before Harmony can use it as couple guidance.
AI answers, summaries, and suggestions may be incomplete or wrong. Review them using your own professional judgment and the information you obtain directly from the client.
5. Confidentiality and account security
Protect your sign-in email, devices, downloads, and any information you move outside Harmony. Do not share your login or allow an unauthorized person to use your portal. Sign out of shared devices and promptly report suspected unauthorized access to professionals@talkharmony.app.
The portal is not your practice's legal record, electronic health record, or emergency communication system. Keep any records your profession or jurisdiction requires in your own approved systems.
6. Healthcare and HIPAA boundaries
Harmony is not a healthcare provider, licensed therapist, diagnosis service, crisis service, or emergency service. It does not replace therapy, counseling, clinical judgment, mandated reporting, or emergency care.
Unless Harmony and your organization have signed a separate Business Associate Agreement, do not treat Harmony as your HIPAA business associate and do not upload records from your practice, EHR, or another covered source into the portal. A client's decision to connect their own Harmony account does not by itself create a Business Associate Agreement with your practice.
If a person may be in danger or needs urgent help, use your established safety procedures and appropriate emergency or crisis resources rather than relying on Harmony.
7. License checks and account restrictions
You authorize Harmony and its credential-verification providers to check the professional information you submit against licensing boards and other primary sources. You must promptly tell Harmony if a license expires, is restricted, is suspended, is revoked, or is otherwise no longer current.
Harmony may correct a verification status, remove a verified badge, disable a Harmony code, suspend access, or close an account when credentials cannot be confirmed, information is inaccurate, the account creates a privacy or safety risk, or these terms are not followed. Harmony may preserve limited audit and acceptance records when legally or operationally necessary.
8. Acceptable use
Do not use Harmony to impersonate another professional, misstate credentials, coerce a client, access information without permission, evade client controls, provide unlawful services, harass anyone, introduce malicious code, scrape the portal, reverse engineer protected systems, or interfere with Harmony's security.
Your public name and code must not contain private contact information, unsupported credentials, misleading claims, or language that suggests Harmony endorses your practice.
9. Ownership and service changes
You keep ownership of guidance and other material you author. You give Harmony a limited right to store, process, and present that material only as needed to provide the features you and the client choose. Harmony and its licensors own the portal, software, designs, and generated product features.
Harmony may change, pause, or discontinue portal features. We will provide reasonable notice when a material change affects professional use, client permissions, or these terms, when notice is practicable.
10. Disclaimers and responsibility
The portal is provided as available without a promise that it will be uninterrupted, error-free, or suitable for every client. To the fullest extent allowed by law, Harmony disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
You remain responsible for your professional services, clinical decisions, documentation duties, client communications, and compliance with laws and licensing rules. To the fullest extent allowed by law, Harmony is not liable for indirect, special, incidental, consequential, or punitive damages arising from portal use. Nothing in these terms limits rights or liability that law does not allow us to limit.
11. Ending access and legal terms
You may stop using the portal and request account closure at any time. Client permissions end according to the controls shown in Harmony. Sections concerning privacy, confidentiality, ownership, responsibility, and legal terms continue after access ends where their purpose requires it.
These terms are governed by California law, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be handled in the state or federal courts located in Sacramento County, California, unless applicable law requires another forum.
If one part of these terms is unenforceable, the rest remains effective. These terms and the policies they reference are the complete agreement for the professional portal unless Harmony signs a separate written agreement with your organization.
